Terms of Service — Footy Cup 26

These Terms of Service ("Terms") govern your use of the mobile app Footy Cup 26 (the "App"), provided by Luminae Labs Ltd ("we", "us", "our"), a company registered in England and Wales (company number 17124756), registered office 27 Old Gloucester Street, London, WC1N 3AX, United Kingdom. By downloading, accessing or using the App, you agree to these Terms. If you do not agree, do not use the App.

These Terms work together with our Privacy Policy, which explains how we handle information.

1. Eligibility

You must be at least 13 years old to use the App. If you are under the age of majority in your country, you may use the App only with the involvement and consent of a parent or guardian. The App is not directed at children under 13.

2. Licence to use the App

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use the App on a device you own or control, for your own personal, non-commercial use, subject to these Terms and to the rules of the app store you downloaded it from.

You agree not to: copy, modify, distribute, sell or lease any part of the App; reverse engineer or attempt to extract the source code, except where this restriction is prohibited by law; use the App for any unlawful purpose; or interfere with or disrupt the App or its infrastructure.

3. Purchases and payments

The App is a paid app. Your purchase is processed by the app store you bought it from (the Apple App Store or Google Play), under that store's terms. We do not receive or store your payment card details. Any refunds are handled by the relevant app store in accordance with its policies, not by us.

4. Predictions, leaderboards and leagues

The predictions, leaderboards and private leagues are provided for entertainment purposes only. They are not betting, gambling or a game of chance, they do not involve real-money wagering, and they do not award monetary prizes unless we expressly state otherwise. Match results are entered and updated manually and may be delayed or contain errors. We may correct, recalculate or reset scores and standings to fix mistakes or to keep the feature working fairly.

5. Your content

The App lets members of a private league exchange messages. You keep ownership of the content you create. By posting content, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce and display that content for the sole purpose of operating and providing the App. You are responsible for the information you choose to send, publish or share through the App, and you confirm you have the right to share it.

6. Acceptable use and community rules

We operate a zero-tolerance approach to objectionable content and abusive behaviour. You must not send, publish or share content that is unlawful, harassing, threatening, abusive, hateful, defamatory, obscene, sexually explicit, or that infringes the rights of others, and you must not impersonate any person, spam other users, or attempt to harvest other users' information.

Within the App you can report content and report or block other users. We may, at our sole discretion and without prior notice, remove any content, and suspend or permanently ban any user who we believe has breached these Terms or whose conduct is harmful to other users. We are not obligated to monitor content, but we may do so.

7. Match data and third-party content

Fixtures, results, standings, team names and flags are provided for information and identification only, on an "as is" basis. We do not warrant that this information is accurate, complete or up to date.

8. No affiliation and intellectual property

Footy Cup 26 is an independent app. It is not affiliated with, endorsed by, sponsored by or associated with FIFA, the organisers of the 2026 tournament, any national football association, any club, any team, any player, or any broadcaster. Team names and national flags are used solely to identify the participants. All rights in the App, including its software, design, name and logo, belong to Luminae Labs Ltd or its licensors.

9. Service availability and changes

While we use reasonable measures to keep the service available, we do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue all or part of the App, including any feature, at any time, with or without notice.

10. Disclaimer of warranties

To the maximum extent permitted by applicable law, the App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of satisfactory quality, fitness for a particular purpose, accuracy, or non-infringement. Some of these exclusions may not apply to you if you are a consumer and your local law does not allow them.

11. Limitation of liability

To the maximum extent permitted by applicable law:

We are not liable for any indirect, incidental, special or consequential loss, or for any loss of data, profit or goodwill, arising out of or in connection with your use of, or inability to use, the App.

We are not liable for content posted or actions taken by other users, including any content shared in private league chat.

Our total liability to you for all claims arising out of or in connection with the App is limited to the amount you paid for the App.

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for any rights you have as a consumer that cannot be excluded or limited under the law of your country.

12. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Luminae Labs Ltd from any claims, losses, liabilities and expenses arising out of your content, your use of the App, or your breach of these Terms.

13. Termination

You may stop using the App at any time. We may suspend or end your access to the App if you breach these Terms or to comply with the law. Sections that by their nature should survive termination, including those on your content licence, disclaimers, limitation of liability and indemnity, will continue to apply.

14. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales will have jurisdiction. If you are a consumer resident elsewhere, you keep the benefit of any mandatory protections and the right to bring proceedings under the law of your country of residence.

15. Apple App Store

If you downloaded the App from the Apple App Store, the following also applies. These Terms are between you and Luminae Labs Ltd only, not with Apple, and Apple is not responsible for the App or its content. Your licence to use the App is limited to use on Apple-branded devices under the Usage Rules in the Apple Media Services Terms and Conditions. Apple has no obligation to provide maintenance or support for the App. In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price to you, if any; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Luminae Labs Ltd, not Apple, is responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims arising under consumer protection or similar legislation, as well as any third-party claim that the App infringes that third party's intellectual property rights. You represent that you are not located in a country subject to a relevant government embargo and that you are not on any government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

16. Changes to these Terms

We may update these Terms from time to time. The most recent version will be made available in the App, and your continued use after an update means you accept the updated Terms.
